Racing or stunt driving is a criminal offence in Ontario. Trying to perform high-risk maneuvers amid squealing tires can result in the offenders considering their options for criminal defense. In such circumstances, a statute provides for the vehicle to be impounded and for the operator's license to be suspended, both for a period of seven days. A conviction can lead to demerit points, stiff fines, a longer licence suspension and even jail time.
The Ontario Provincial Police reported two separate incidents of alleged car racing that led to arrests on a recent Monday. The first incident occurred in City of Guelph on Highway 6 in Wellington County shortly after 11 a.m. Officers monitored the motorist's speed by using radar equipment at a section of road with an 80 km/h speed limit. They locked the speed travelled by a 28-year-old driver at about 139 km/h.
The second incident occurred in Puslinch Township shortly before 3 p.m. on the same day. A 20-year-old driver who was travelling in a 50 km/h zone was clocked on radar at about 104 km/h. Officials impounded the vehicles of the drivers in both incidents for seven days and suspended their driver's licences for the same period of time. They are scheduled to answer to charges of racing a motor vehicle on the same date in December.
A criminal charge is a serious event for any Ontario resident and typically causes uncertainty and fear regarding what is to come. The most sensible step for any person facing such charges is to seek the support and guidance of an experienced criminal defense lawyer. A seasoned lawyer can answer questions and help prepare and present a meaningful defense. After assessing the charges and the validity of the radar readings, the lawyer can work to achieve the best outcome under the circumstances.
