Execution of CDSA search warrant leads to drug charges

When residents of Ontario are accused of crimes related to drugs, they will likely seek legal advice to make sure the appropriate steps are taken to protect their legal rights. Regardless of whether charges involve trafficking, possession, cultivating or other drug charges, the consequences of a conviction can be devastating. Depending on the type of drug, the quantity seized and other circumstances surrounding the arrest, the penalties -- if the accused individual is convicted -- can range from stiff fines to incarceration.

Two residents of Smiths Falls were taken into custody and are awaiting a bail hearing after their recent arrests. Those accused are a 50-year-old man and a 54-year-old woman who were arrested after the execution of a CDSA drug search warrant at a residence in Smiths Falls. During the search, police found and seized marijuana and cocaine -- 20 grams and 70 grams, respectively -- along with various paraphernalia related to drugs and a variety of pills that were not identified. Three vehicles and a weapon were also seized.

The two individuals were jointly charged with three counts each of controlled substance possession and possession of property obtained unlawfully, along with one count of possession of an unauthorized firearm. The prosecution will use the evidence obtained during the execution of the search warrant, along with any previously obtained evidence that may include surveillance material, wiretaps, statements by witnesses and informants. Also, anything said in statements by the accused individuals after their arrests may be used against them.

For this reason, the support of an experienced Ontario criminal defence attorney can be invaluable in the defence against the drug charges. A skilled legal representative can be present during any interviews or questioning to ensure accused individuals do not make self-incriminating statements. The methods used to obtain evidence will be scrutinized, and a lawyer can explain the possible consequences and the feasibility of entering a guilty plea. Guidance and advice can be provided based on the unique circumstances, and the best possible outcome will be pursued.
