The Ontario court of Appeal in 2014 in Kukemueller had to decide if being belligerent with the police constituted causing a disturbance.
Mr. Kukemueller was with a group of friends and the police just arrested 2 persons he knew. Upset, Mr. Kukemueller reacted by loud, profane and angry tirade against the police. He was arrested for causing a disturbance.
The conviction was set aside and he was acquitted. His conduct did not interfere with the public's normal activities or with the ordinary use by the public of the place in question.
The court also indicated that contributing to raising the tension during police interaction or causing emotional upset to another person, does not rise to the level of criminal conduct.
