I do not have full-time custody of my children, what are my rights?

A parent does not lose parental authority attributes simply because he/she does not have full custody of a child. Parents are responsible for the safety, development and social integration of their Children. Consequently, parents have rights and obligations in regard to their minor children, that is what is called parental authority. This parental authority is divided into 5 attributes:

  • The right and duty of guardianship : every minor child has, as its domicile its parents' residence and they, in turn have a duty to provide it shelter until majority;
  • The oversight duty : that is to ensure the safety of their children and of third parties;
  • The duty to feed and ensure the provision of material and affective needs of their children.
  • The right and duty to educate their children in both the schooling and civic spheres; and
  • The duty of guardianship : parents represent their children in respect of their civil rights, they administer their estate and ensure the protection of their rights.

Non-guardian parents maintain a supervisory capacity and the right to be kept informed of the child condition. It is its duty to oversee decisions taken by the guardian parent and to contest them as required.
